Lamar County and District Attorney Gary Young said all charges have been dropped against a Lamar County man arrested in November 2011 as a suspect in a hate crime assault in Reno.

Daniel Shawn Martin, 33, was arrested Nov. 1, along with two others. All three were charged in the crime, but Martin said he was not even there when the assault took place Oct. 30.

“We had a number of witnesses who came forward to say Martin was not there, and it was confirmed he was not involved,” Young said. “Also the victim confirmed Martin was not the assailant.”

James Mitchell Laster III pleaded guilty to the assault with deadly weapon and hate crime enhancement on Feb. 21, and a second man, Mickey Smith, arrested later, also pleaded guilty April 13 to assault with hate crime enhancement and was sentenced to 10 years in prison.

“I’m glad to get this behind me,” Martin said. “I had left with a girlfriend before the assault happened and never should have been arrested.”
